1. General Information
These Terms and Conditions apply to all services provided by Simon Köhler ("the Freelancer"), a self-employed service provider based in Panama. By commissioning services, the client agrees to these terms.
2. Services Offered
The Freelancer offers web development, design, marketing, and related digital services, either on a fixed-price or hourly basis.
3. Currency and Payment Methods
- Clients based in Germany will be invoiced in EUR.
- All other clients will be invoiced in USD.
- Accepted payment methods include:
- SEPA Bank Transfer (EU clients)
- SWIFT Bank Transfer (USD)
- PayPal
- Bitcoin
4. Pricing & Payment Terms
- Fixed-price Projects:
- 40% of the agreed total is due upfront before work begins.
- 50% is due upon project completion and before final delivery.
- The remaining 10% may be waived or used as a buffer for revisions (to be discussed per project).
- Hourly Work:
- Hourly rates range from $25 to $80, depending on the type and complexity of the work.
- Time tracking is provided on request.
- Invoices are typically issued bi-weekly or monthly, unless otherwise agreed.
5. Revisions and Modifications
Unless agreed upon otherwise, fixed-price projects include up to two rounds of revisions. Additional changes may be billed at the standard hourly rate.
6. Intellectual Property
Upon full payment, the client receives full usage rights to the final work. The Freelancer retains the right to showcase the work for portfolio and marketing purposes unless the client requests otherwise in writing.
7. Cancellation Policy
If the client cancels a project after work has begun, the advance payment is non-refundable. Any work completed beyond the advance amount will be invoiced separately.
8. Liability and Warranty
The Freelancer guarantees the work will be free from major defects at the time of delivery. However, no liability is accepted for issues arising from third-party systems, hosting, plugins, or client modifications after handover.
9. Jurisdiction
These terms are governed by the laws of Panama. Any disputes will be resolved under Panamanian jurisdiction, unless otherwise agreed.
